These Terms of Service (“Terms”) form a legally binding agreement between you and Helping Hand (“we”, “us”, “our”), 3569 Kennedy Court, Charlestown, Massachusetts 02129, United States, governing your use of https://www.cnnehome.com/ (the “Site”) and your purchase of products from us.

By accessing the Site or placing an order you agree to these Terms. If you do not agree, do not use the Site or place an order.

1. Eligibility

You must be at least 18 years old, or the age of majority in your jurisdiction, to place an order. By ordering you confirm that you are legally able to enter this agreement. We may refuse or cancel service to anyone at our discretion, including where we suspect fraud or where we cannot lawfully sell a product to your location.

2. Products and Product Information

We sell smart home devices and related accessories. We try to describe products accurately, including specifications, dimensions, compatibility, voltage ratings, wireless certifications and package contents. However:

  • Product images are for illustration. Actual colour, finish or minor design revisions by the manufacturer may differ.
  • Specifications may change without notice as manufacturers revise firmware, hardware or packaging.
  • Compatibility with your existing equipment, wiring, network, hub or voice assistant is your responsibility to verify before ordering. Compatibility lists on product pages reflect the manufacturer’s stated support at the time of writing.
  • Products are supplied for the region stated on the product page. Voltage, plug type, wireless certification and lawful use vary by country; see our Shipping Policy.

Any error in a product description, specification or price is unintentional. We reserve the right to correct errors, and to cancel an order affected by a material error, in which case any amount paid is refunded in full.

3. Prices and Taxes

All prices are shown in United States dollars (USD) unless stated otherwise, and exclude shipping, customs duties and import taxes, which are shown separately at checkout or described in our Shipping Policy. Prices may change at any time; the price that applies is the price shown when your order was placed.

Sales tax, VAT, GST or similar charges are added where we are legally required to collect them, based on your delivery address. You are responsible for import duties and taxes on international orders.

4. Orders and Contract Formation

Placing an order is an offer to buy. Our acceptance — and the point at which a contract is formed — occurs when we send you the order dispatch confirmation, or when the payment is captured, whichever happens first. The order confirmation email you receive immediately after checkout acknowledges receipt of your order; it is not acceptance.

We may decline or cancel an order where: the item is out of stock or discontinued; the price or description contains a material error; payment cannot be authorised; we cannot lawfully ship to your address; or we reasonably suspect fraud. If we cancel after you have paid, we refund the full amount.

5. Payment

Payment is due in full at checkout. We accept the payment methods displayed at checkout. Card transactions are processed by our third-party payment providers; we do not store your full card number. You confirm that you are authorised to use the payment method submitted. If your payment is declined, no contract is formed and no goods are shipped.

Where a chargeback is filed against a settled order, we may suspend the associated account and pursue recovery of the goods and costs.

6. Delivery, Risk and Title

Delivery times are estimates and are set out in our Shipping Policy. Risk of loss or damage passes to you when the carrier delivers the parcel to the address you provided. Title passes when payment has cleared in full. Delivery to a carrier for shipment to you is not delivery to you for the purposes of cooling-off and similar statutory periods, which run from the day you, or a person you nominate, take physical possession.

7. Installation, Electrical Work and Safe Use

Smart home products may require electrical installation, mounting, network configuration or firmware updates.

  • Installation involving building wiring, circuit breakers, hardwired fixtures or any work inside an electrical panel must be carried out by a qualified, licensed electrician in accordance with your local electrical code. We are not responsible for damage or injury arising from unqualified installation.
  • Do not open, modify or repair a product’s enclosure or power supply. Doing so voids the warranty and may create a fire or shock hazard.
  • Use only the power adapter and cables supplied or specified on the product page.
  • Devices rated for indoor use must not be installed outdoors, and devices without the relevant ingress protection rating must not be installed in bathrooms, kitchens or other wet locations.
  • Cameras, doorbells, sensors and audio devices may capture footage or sound of other people. You are solely responsible for complying with local surveillance, recording, notification and data protection laws in your jurisdiction, including obtaining any required consent.
  • Safety-critical functions — smoke detection, gas detection, water leak detection, door locks, medical alerting — depend on power, network connectivity and correct configuration. Do not rely on any connected device as the sole means of protection for life or property. Maintain independent, code-compliant detectors and physical security measures.

8. Firmware, Software and Third-Party Services

Products may depend on companion applications, cloud services, subscriptions or third-party platforms to function. Those services are provided by the manufacturer or a third party and are subject to their own terms. We are not responsible if a manufacturer discontinues an app, changes a subscription price, ends cloud support, or alters functionality. We will pass on manufacturer notices where we are aware of them. Products may require firmware updates for continued secure operation; applying them is your responsibility.

9. Your Account

You are responsible for keeping your account credentials confidential and for all activity under your account. Notify us immediately at houke100@gmail.com if you suspect unauthorised access. We are not liable for loss arising from your failure to protect your credentials. We may suspend or close an account used for fraudulent, abusive or illegal activity.

10. Acceptable Use

You agree not to: use the Site for any unlawful purpose; attempt to gain unauthorised access to our systems or another user’s account; interfere with or disrupt the Site, including through automated scraping, excessive requests or malware; upload harmful code; infringe our or any third party’s intellectual property; resell products in breach of applicable distribution or export controls; or use the Site to harass or harm others. We may terminate access to anyone who breaches this section, and reserve all rights to pursue remedies.

11. Intellectual Property

The Site, including its design, text, graphics, logos, product photography, software and compilation of content, is owned by or licensed to Helping Hand and is protected by copyright, trademark and other laws. Third-party brand names, product names and logos are the property of their respective owners and are used for identification only; their use does not imply endorsement by, or affiliation with, those owners.

You may not reproduce, republish, distribute, modify or create derivative works from Site content without our prior written consent, except for personal, non-commercial reference use and except where permitted by law.

12. User Content and Reviews

If you submit reviews, comments, photographs or other content, you grant us a non-exclusive, worldwide, royalty-free, perpetual licence to use, reproduce, display and distribute it in connection with the Site and our marketing. You confirm that your content is your own or that you have the right to submit it, that it is accurate, and that it does not infringe any third party’s rights or violate any law. We may remove content that is abusive, off-topic, fraudulent, infringing or otherwise unsuitable, and we do not endorse the views expressed in user reviews.

13. Warranty Disclaimer

Except for the express limited warranty described in our Refund and Return Policy and any manufacturer warranty that accompanies a product, the Site and products are provided “as is” and “as available”. To the maximum extent permitted by law we disclaim all other warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, non-infringement, and any warranty arising from course of dealing or trade usage. We do not warrant that the Site will be uninterrupted, error-free or free of harmful components, or that any product will interoperate with your particular equipment.

Some jurisdictions do not allow the exclusion of implied warranties, so parts of this section may not apply to you.

14. Limitation of Liability

To the maximum extent permitted by law, neither we nor our suppliers, manufacturers or service providers are liable for any indirect, incidental, special, consequential or punitive damages, or for loss of profits, revenue, data, savings, business or goodwill, arising out of or relating to the Site, any product, or these Terms — even if we have been advised of the possibility of such damage.

Our total aggregate liability for any claim arising out of or relating to a product or these Terms is limited to the amount you actually paid us for the product giving rise to the claim.

Nothing in these Terms limits or excludes liability that cannot lawfully be limited or excluded, including liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, for breach of statutory consumer guarantees that cannot be excluded, or for wilful misconduct. You may also have statutory rights as a consumer that these Terms do not affect.

15. Indemnity

You agree to indemnify and hold harmless Helping Hand and its officers, employees and agents from claims, liabilities, damages, losses and expenses (including reasonable legal fees) arising from: your breach of these Terms; your use of the Site; your installation, configuration or use of a product contrary to the manual, applicable electrical or building codes, or applicable law; your violation of any third party’s rights; or your recording or monitoring of other persons without required consent.

16. Force Majeure

We are not liable for delay or failure to perform caused by events beyond our reasonable control, including natural disasters, epidemics, war, terrorism, civil unrest, government action, trade restrictions, sanctions, labour disputes, carrier failure, network or power outages, cyberattack, and component or semiconductor shortages. Where such an event prevents delivery for more than 30 days, either party may cancel the affected order and you will receive a full refund.

17. Export Controls and Sanctions

Products may be subject to export control and economic sanctions laws. You agree not to export, re-export or transfer any product in violation of applicable law, and confirm that you are not located in, under the control of, or a national or resident of any country or party subject to applicable sanctions or embargoes, and that you will not use products for any prohibited end use.

18. Governing Law and Dispute Resolution

These Terms are governed by the laws of the Commonwealth of Massachusetts, United States, without regard to conflict of law rules, and excluding the UN Convention on Contracts for the International Sale of Goods. Mandatory consumer protection law of your country or state of residence continues to apply where it cannot be contracted out of.

If a dispute is not resolved informally within 30 days, the parties will attempt mediation before filing proceedings. Any action arising out of or relating to these Terms or a purchase must be brought in the state or federal courts located in Suffolk County, Massachusetts, and each party consents to the personal jurisdiction and venue of those courts. Nothing in this section prevents you from bringing a claim in the courts of your place of residence where consumer protection law requires it, or from using small claims procedures where eligible.

Massachusetts consumer rights. Nothing in these Terms limits your rights under the Massachusetts Consumer Protection Act, M.G.L. c. 93A, which prohibits unfair or deceptive acts or practices in trade or commerce. Under M.G.L. c. 93A, §9, a consumer may be entitled to recover actual damages and, where the court finds the respondent acted wilfully or knowingly, double or treble damages, together with reasonable attorneys’ fees and costs. Section 9(3) generally requires a consumer to send a written demand letter at least 30 days before filing suit, stating the complaint, the injury suffered and the relief sought. Nothing in these Terms waives any right you have under Massachusetts law, including the standards protecting residents’ personal information at 201 CMR 17.00 and the data breach notification duties at M.G.L. c. 93H.

19. Entire Agreement, Severability and Assignment

These Terms, together with our Privacy Policy, Refund and Return Policy and Shipping Policy, form the entire agreement between us regarding your use of the Site and your purchase, and supersede any earlier representations. If any provision is held unenforceable, the remainder continues in full effect. You may not assign these Terms without our written consent; we may assign them to an affiliate or to a successor in a merger, acquisition or asset sale.

Our failure to enforce any provision is not a waiver of it. A waiver on one occasion does not waive it on another.

20. Changes to These Terms

We may update these Terms to reflect changes in our business, products or the law. The current version is always posted on this page with its “Last updated” date. Material changes will be announced on the Site or by email. Continued use of the Site after a change takes effect means you accept the revised Terms; the version in force when you placed an order governs that order.
